    The Bombay High Court Has granted bail to Aryan Khan, Arbaaz Merchant and Munmun Dhamecha, in connection with their arrest by the Narcotics Control Bureau (NCB) on October 3, after the agency busted a cruise ship off the coast of Mumbai and seized several banned narcotics on October 2.

    Former Attorney General, Mukul Rohatgi, makes rejoinder statements on behalf of Aryan Khan. He also said there is no material to allege conspiracy.

    “Their case is if it is not a coincidence, but a conspiracy.  There has to be meeting of minds. Say a telephone call between all 8.  So apart from Arbaaz, none of these chaps have anything to do with me,” he said as per LiveLaw.

    “I can understand if even all ten were friends. Apart from the people mentioned in the chart, there were two other people one is Manav and Gaba(who invited me). They were not arrested,” Rohatgi added.

    Former Attorney General, Mukul Rohatgi, makes rejoinder statements on behalf of Aryan Khan.

    “There was no recovery from me. Though I say I was not aware what he was carrying.  But what is being put on me is commercial quality through conspiracy,” he said as per LiveLaw.

    “So basically what five other people are carrying is put on me. But section 27A is not applied against me. There were 1300 people on the ship. No material produced by NCB to show that I knew anyone else apart from Arbaaz and Aachit,” Rohatgi added.

    ASG Singh says that the lower court magistrates remande orders shouldn’t be challenged, and says that that the argument by Mukul Rohatgi regarding the illegal arrest of the accused does not contain any merit.

    “Three remand orders of the magistrate have not been challenged. So now the accused cannot say the arrest is illegal,” he said as per LiveLaw.

    “They must satisfy the court that the Magistrate has not taken all the factors into consideration while passing the remand order. But here the remand is only not challenged,” he added.

    ASG Singh, while referring to the seizure panchnama, argues that the 6gms of charas which was recovered from the shoe of Arbaaz Merchant, was meant to be consumed by Aryan Khan and Arbaaz Merchant on the cruise.

    Citing the events on that took place on the night of October 2, ASG Anil Singh says he is accusing them of conspiracy after “calculating drugs: of the eight people detained by the NCB that night.

    “Can't say it was only for consumption. We have applied 29 because out of 11 names in the secret note, eight have been apprehended,” he said as per LiveLaw. He also added that the cumulative quantity is the equal to commercial quantity.

    After the court asked for NCB’s proof to suppoer the argument that Aryan Khan dealt in commercial quantities, ASG Singh, as per LiveLaw said, “The WhatsApp chat will show he made an attempt to deal with commercial quantity, that's all.”

    Singh further added that multiple drugs were recovered from the eight people apprehended on the night of Oct 2.  Court counterquestioned and asked Singh if “cumulative effect should be given?” Singh replies and says “it has to be investigated”.

    ASG Anil Singh argues defence’s arguments about not getting tested for consumption does not hold any ground, since the NCB has only booked them for possession.  

    “They travelled together, they were going to be put up in the same room,” he said, as per LiveLaw.

    ASG Anil Singh argues that while no recovery was made from Aryan Khan, he may still be booked under section 8c under the NDPS, for “conscious possession”.

    “The scope of section 8(c) is very wide. Therefore there may be a case that the person has not consumed the drug but is found in possession, 8(c) will apply,” he said, as per LiveLaw.  

    “We have argued conscious possession in the sessions court as well. That if two people are travelling together, and the first person is knows the drug is with the other and it is for their consumption...Though the person may not be in actual physical possession, he may be in "conscious possession," he added.

    Arguing for Arbaaz Merchant, advocate Amit Desai has told the court that in incidents of minor possession, the law’s approach is to grant the accused bail in most cases, and not jail them. Reading out a previous judgement, Desai said that the law prescribed police authorities to let people accused of minor offences, go on bail.

    "In minor offences, arrest is the exception. This is the diktat of the Arnesh Kumar judgment. And this is the change in approach of the police. Bail is the rule and jail is the exception. Now it has become 'arrest is the rule and bail is the exception',” he said, as quoted by Live Law.
